1. How do I qualify for disability retirement?

As long as you are not a member of the Virginia Sickness and Disability Program (VSDP), you may apply for disability retirement (VRS forms 6 through 6D) if you become mentally or physically incapable of performing the duties of your present job and if the disability is likely to be permanent.

2. Must I stop working to apply for disability benefits?

No, you may continue to work while your application is being processed. Your employer will be asked how your duties have been modified to allow you to continue working. You must quit work, however, before VRS can pay your benefit.

3. Can I apply for disability if I have stopped working?

You must apply within 90 days of termination of your employment or within 24 months of being placed on leave.

4. How does VRS decide if I qualify for disability retirement?

The VRS Medical Board, which is composed of physicians, reviews your medical information and makes a recommendation to VRS staff on whether or not to approve your disability application.

5. If I apply for disability retirement and my application is denied, can I appeal the decision?

Yes, you have two chances to appeal the decision. You must appeal the decision within 90 days of receiving the denial letter. If you do not send a notification of appeal within 90 days, the appeal process is ended and the Medical Board's decision becomes final. If this appeal is denied, you have 30 days of the denial to send in a notification of appeal. If the notification of appeal is not received within 30 days the appeal process ends and the decision of the Medical Board becomes final.
