Non-Covered Employment with the Same Employer

After you retire, you can work in a temporary, part-time hourly or adjunct faculty position with the same employer provided you have a bona fide break in service as required by the Internal Revenue Service (IRS). VRS requires a break of at least one full calendar month after your retirement date over a period you normally would work.

The Commonwealth of Virginia, including all state agencies and public colleges and universities, is considered one employer.

Example: You retire from the Department of Motor Vehicles and want to work in a position with the Department of Corrections not covered under VRS. You must have a break in service of at least one full calendar month after your retirement date from the Department of Motor Vehicles before starting part-time hourly work at the Department of Corrections to continue receiving your retirement benefits.

Public school divisions are considered separate employers.

Example: You retire from Henrico County Public Schools and accept employment with Hanover County Public Schools in a position not covered under VRS. You are not required to have a break in service from Henrico County Public Schools before beginning part-time hourly employment with Hanover County Public Schools to continue receiving your retirement benefits.

Political subdivisions, including cities, counties, towns, commissions, authorities and other political subdivisions, are considered separate employers.

Example: You retire from the Town of Abingdon and accept employment with Goochland County in a position not covered under VRS. You are not required to have a break in service from the Town of Abingdon before beginning part-time hourly employment with Goochland County to continue receiving your retirement benefits.
